The fees for Austria and Switzerland depend on the number of classes, and we calculate them individually for you. For Switzerland and Austria, a local representative may also be required in opposition proceedings.
Check first, then file
Neither the DPMA nor the WIPO checks whether your trademark conflicts with an earlier one. Owners of earlier trademarks can, however, file an opposition, separately in Germany, Austria and Switzerland. One earlier right in one country is enough to take away your protection there. That is why, with the BUSINESS package, we search all relevant registers before filing. You get a written assessment from a lawyer and then decide on the filing.
What classes mean
Germany, Austria and Switzerland use the same 45 Nice classes for goods and services. We draft your list of goods and services for the German trademark together with you. The IR mark adopts this list and cannot be broader. DPMA: €290 official fee for up to 3 classes, €100 for each additional class. The WIPO fees for designating Austria and Switzerland depend on factors including the number of classes and the type of trademark, and are calculated individually. Important as always: you cannot expand later. A forgotten class means a new application.
Save money by filing yourself?
You pay the official fees in any case. The only thing you can save is our fee. In return, you file yourself: the German trademark with the DPMA and the IR mark designating Austria and Switzerland with the WIPO via the DPMA, each with their own forms, fees and deadlines. You also draft the list yourself, and it cannot be expanded later. If you can do that: legitimate. If not: one order, one contact person, one fixed price. And we are liable for our advice, insured up to €2.5 million.

Register a DACH trademark: the essentials
Three countries, three legal systems, one economic area
For many companies, Germany, Austria and Switzerland are a single market: same language, interlinked supply routes, shared platforms. In trademark law, they are three separate countries. That is why our DACH solution consists of two applications: a German trademark with the DPMA and an IR mark with the WIPO, in which we designate Austria and Switzerland.
Two trademarks, three countries
The IR mark is a bundle of rights: Austria and Switzerland each examine their designation under their own law, and an opposition in one of the two countries only affects protection there. The German trademark is the base. For the first 5 years, the IR mark depends on it: if the German trademark is cancelled during this period, protection in Austria and Switzerland falls away too. A search before filing (in the BUSINESS package) therefore safeguards both trademarks.
The priority period: a 6-month head start
If you file in Germany first, you can follow up with the IR mark within 6 months and claim the German priority (Paris Convention). Your IR mark application designating AT and CH is then treated as if it had been filed on the German filing date. The IR mark is also possible later, as long as the German base mark exists, but then without this priority.
What the offices examine and what they don't
The DPMA examines whether absolute grounds for refusal stand in the way of your trademark, for example whether it is distinctive or merely descriptive. Austria and Switzerland examine the designation under their own law. The DPMA and WIPO do not check whether earlier identical or similar trademarks exist. Monitoring for conflicts is up to the owners of earlier trademarks, who can file an opposition. That is why a search before filing pays off (in the BUSINESS package).
After registration: keep an eye on two trademarks
After registration, you have two trademarks: the German trademark and the IR mark designating Austria and Switzerland. Both run for 10 years and are renewed separately, the IR mark centrally with the WIPO. Once the 5-year grace period for use has expired, the trademark must be used in its registered form, otherwise it becomes vulnerable. You can only file an opposition against similar new applications within the opposition period; after that, invalidity proceedings remain. Trademark monitoring for your German trademark helps you notice such applications in time.

Switzerland is not an EU member. The EU trademark covers Germany and Austria but stops at the Swiss border. For Switzerland, you need an additional application.
Not a right of its own, but two trademarks: a German trademark with the DPMA and an IR mark with the WIPO designating Austria and Switzerland. We do not file national applications in Austria or Switzerland. We bundle both applications in one order.

Yes. In principle, you can file the IR mark at any time as long as a German base mark exists. The 6 months only matter for priority: if you file the IR mark within 6 months of the German application, the German filing date applies for Austria and Switzerland.
No, neither the DPMA nor the WIPO. That is why, in the BUSINESS package, we search all relevant registers before filing. The BASIC package does not include a search.
An opposition against the IR mark in Austria or Switzerland only affects protection in that country. However, the German trademark is the basis of the IR mark: if it falls away within the first 5 years, for example after a successful opposition, the IR mark for Austria and Switzerland falls too. Opposition proceedings are not included in the fixed price; should the need arise, you receive a fixed-price quote.
Two procedures run when you file: the German trademark with the DPMA and the IR mark with the WIPO, whose designation Austria and Switzerland each examine under their own law. How long this takes varies by office, from a few weeks to several months. If there is an opposition, up to three separate proceedings run, one per country.
Not for filing: we submit the IR mark to the WIPO via the DPMA. It is different in opposition proceedings: if there is an opposition in Austria or Switzerland, a representative or an address for service in that country may be required. We will then clarify this with you.
At the DPMA, up to 3 classes are included in the €290 official fee, and each additional class costs €100. The WIPO fees for Austria and Switzerland depend on the number of classes and are calculated individually.
10 years, after which you can renew for 10 years at a time, as often as you like. The German trademark is renewed with the DPMA, the IR mark centrally with the WIPO, without you having to designate the countries again.
No. South Tyrol is part of Italy and is not covered by the DACH trademark. Liechtenstein must also be filed separately, for example through an additional designation in the IR mark.
