Employment contracts come from the employer, and they are worded accordingly. These are the clauses we look at. At the end you know for each clause: binding, invalid or open to negotiation.
Notice periods: Do longer notice periods apply to you than to your employer? That is not permitted, but it still appears in many contracts.
Overtime rules: "Compensated by your salary" is only valid within narrow limits. We check whether your clause costs you paid overtime.
Non-compete clause: A post-contractual non-compete without compensation for the restricted period (Karenzentschädigung) is not binding on you. We check what really binds you after the job.
Vacation entitlement: The statutory minimum, additional contractual vacation and what happens to remaining vacation days upon termination.
Fixed term: Was the fixed term validly agreed? Formal errors in the fixed term can mean that a permanent employment relationship exists.
Forfeiture clauses: Deadlines after which your claims (e.g. to wages or overtime pay) lapse. Deadlines that are too short are invalid, and we tell you which ones apply.

Employment contract review: the essentials
Why your employment contract is written in the employer's favor
Employment contracts are practically always provided by the employer, usually as a standardized template the HR department has used for years. Legally, that makes them standard business terms (Allgemeine Geschäftsbedingungen), which are subject to content review: clauses that unreasonably disadvantage you are invalid. The problem: they are still in the contract, and very few employees know which clause holds up and which does not.
Overtime: the most expensive clause in the contract
"Overtime is compensated by the salary": this sentence appears in countless contracts and, in this blanket form, is regularly invalid because it is not clear how much extra work you will face. Only clauses with a clear limit are valid. With consistent overtime, the difference quickly adds up to several thousand euros a year, unpaid or paid, depending on how good your clause is.
Forfeiture clauses: the silent deadline
Exclusion or forfeiture clauses provide that claims arising from the employment relationship lapse after a deadline if you do not assert them, often 3 months. Shorter deadlines are invalid, as are clauses that cover the minimum wage. If you do not know the clause, you lose claims to wages, overtime or expenses without noticing. The review report tells you which deadlines really apply to you.
Non-compete clause: binding only in exchange for money
A post-contractual non-compete clause prohibits you from working for competitors after you leave. It is only valid in exchange for compensation for the restricted period (Karenzentschädigung) of at least half of your most recent pay, for a maximum of 2 years. If the compensation is missing, the restriction is not binding on you: you can choose whether to comply with it. But only those who have had their contract reviewed know they have that choice.
Fixed term: a formal error can be to your advantage
A fixed term must be agreed in writing before work begins. If it is not, the contract is considered permanent. Fixed terms without an objective reason are also subject to limits: generally a maximum of 2 years with no more than 3 extensions, and not after previous employment with the same employer. For fixed-term contracts, we check these points as well.
Transfer clauses and job description
The vaguer the job description, the broader the employer's right to give instructions: someone hired "as an employee in administration" can be transferred more easily than a "head of accounting at the Munich location". Broad transfer clauses on location and duties are a negotiating point many people overlook, until the employer makes use of them.

After you sign, the only things that help are the invalidity of individual clauses or your negotiating skills at the next contract amendment.
