Buying property usually involves several hundred thousand euros, and the draft contract usually comes from the seller's side. We check these points from your perspective as the buyer. At the end you know where the draft deviates from a buyer-friendly provision, and exactly what to tell the notary or seller before notarization.
Release from encumbrances: is it ensured that the seller's registered land charges and mortgages are deleted before your money flows?

The notary's role, and its limits
No property purchase without a notary: the purchase contract must be notarized. Many buyers conclude from this that the contract is therefore automatically in their interest. That is a misunderstanding. The notary is required by law to be neutral: the notary ensures legally effective notarization and explains the legal implications, but does not advise either side one-sidedly and does not assess whether the price, the exclusion of warranty or the handover date are regulated favorably for you. In addition, the draft is regularly prepared based on information from the seller or the real estate agent.
The 14-day period is your review time
For contracts between businesses (e.g. developers, professionals brokered by real estate agents) and consumers, the notary should provide the draft contract 2 weeks before notarization. This period exists for exactly this purpose: so you can review the text and clarify questions. If you let it pass unused and only think through the content of the draft for the first time at the appointment, you give away your strongest position, because after notarization the contract is binding.
Due date and release from encumbrances: the security mechanism
The buyer's most important protection lies in the sequence: only once the priority notice of conveyance is registered in the land register, the deletion of the seller's land charges is secured and any pre-emption rights are clarified does the purchase price become due. If this mechanism has gaps, in the worst case you pay for an encumbered property and are left as an ordinary creditor if the seller becomes insolvent. Nobody reads exactly these passages as closely during a review as a lawyer who only has your side in view.
Exclusion of warranty: standard, but negotiable
Used properties are almost always sold with liability for material defects excluded. That is common and legitimate for sellers. What matters is what you set against it: assurances about specific features (year of construction, living space, dampness, approved conversion) belong in the notarial deed, not in the sales conversation. Because verbal side agreements on a transaction that requires notarization are void for lack of form: what is not in the contract does not legally exist.
The cost comparison every buyer should do
The incidental costs of buying property are usually 10 to 15% of the purchase price: real estate transfer tax (3.5 to 6.5% depending on the federal state), notary and land register (around 1.5 to 2%), often a real estate agent's commission. With a purchase price of €400,000, that is €40,000 or more, accepted as part of the deal. A lawyer's review of the contract this deal rests on costs €259. It is the only one of these items that represents your interests exclusively.
Typical changes from practice
After our review, buyers most often change: the conditions for the due date (security before payment), the handover date including a provision for a late move-out, the inclusion of assured features and the treatment of outstanding development charges.
