Termination for owner occupancy: what matters now
Owner occupancy is one of the most common grounds landlords use for termination. But owner occupancy only exists if the landlord needs the entire rented apartment or the whole house to live in, for themselves or for a family member. In many cases the termination is invalid, and you have the option of taking legal action against it.
The requirements the termination must meet
A valid termination for owner occupancy needs three things: - Form: The termination must be in writing and signed by all landlords. - Reasons: The letter must name the person who needs the apartment and explain in a comprehensible way why they need it. Generic wording is not enough. - Notice period: The statutory notice period depends on how long you have rented: 3 months for up to 5 years, 6 months after 5 years, 9 months after 8 years of tenancy. If any of these points is missing or flawed, the termination can be challenged.
Your options as a tenant
- Have it reviewed: Only once form, deadline and reasons have been checked do you know whether you have to move out at all. Do not sign anything beforehand, including a move-out agreement. - Hardship objection: If moving out would mean particular hardship for you, for example due to age, illness, pregnancy or lack of alternative housing, you can object under § 574 BGB. The objection must be in writing and reach the landlord no later than 2 months before the notice period ends. - Negotiate: Even if the termination is valid, move-out dates and compensation are negotiable.
