Why buying from a developer is different
With a property developer contract, you buy two things in one: a piece of land (or a co-ownership share in it) and construction work that has yet to be performed. So over months you pay considerable sums for something that does not yet exist, trusting that the developer will finish building, deliver on time and remedy defects. The contract is the only instrument that secures this trust. And it is written entirely by the developer.
The payment schedule: your biggest lever
The Real Estate Agents and Developers Ordinance (MaBV) only allows installment payments according to construction progress and caps them in up to 7 installments: for example 30% after the start of earthworks (25% without a land share in the installment would be a different situation), further installments after the shell, windows and readiness for occupancy. The idea: you should never have paid significantly more than the value standing on the land. Payment schedules that demand payment earlier or in larger amounts shift the developer's insolvency risk onto you.
The construction specification: paper beats brochure
The glossy brochure shows visualizations, but the contract owes you the construction specification. Only what is stated specifically there (materials, manufacturer standards, fitting details, sound insulation level) can you demand later. Wording such as "high-quality fittings" or "at the developer's discretion" opens up leeway that will be used against you in case of doubt. Since 2018, construction contract law has also prescribed minimum content for the construction specification for consumers; gaps are interpreted to the developer's disadvantage, but you do not want to have to fight that dispute in the first place.
Acceptance: the most important date of the project
With acceptance, you acknowledge that the work essentially complies with the contract. From then on, the limitation period for defect claims begins to run (5 years for buildings), the burden of proof for defects shifts to you, and the final installment becomes due. That is why some contracts try to take acceptance out of your hands, for example through acceptance of the common property by an expert appointed by the developer or through deemed acceptance clauses. Case law has struck down such clauses many times. The review report shows you whether your contract tries it anyway.
Completion date and delay
In construction projects, months can quickly pass between the planned and the actual move-in. Without a binding completion date in the contract, you have hardly any claims during this time, but you keep paying rent and commitment interest on your loan. A fixed date plus clear consequences of delay (such as a flat-rate compensation per month of delay) turns a vague hope into an enforceable claim.
Review before notarization: the only right time
After notarization, the contract is binding; changes then require the developer's consent and a new notarization. Before the appointment, by contrast, adjustments are a matter of negotiation with realistic chances, since developers know the case law on invalid clauses. The review for €259 with a report in 24 h fits within the 14-day lead time you are entitled to anyway for consumer contracts.

The notary notarizes neutrally and explains the legal situation. But the notary does not assess whether the construction specification, payment schedule or acceptance provision is economically disadvantageous for you, and the draft comes from the developer. Only your own review brings in the buyer's perspective.
The Real Estate Agents and Developers Ordinance (MaBV) limits the maximum amount the developer may demand for each stage of construction progress: in up to 7 installments at fixed percentages. Payment schedules that deviate from this to your disadvantage are among the most common objections in our review practice: you would be paying ahead of construction and bear the risk if the developer becomes insolvent.
Then it depends on how much you have already paid and how you are secured: a priority notice of conveyance (Auflassungsvormerkung), an MaBV-compliant payment schedule and the 5% completion security are your most important protections. That is exactly why we check these three points especially thoroughly.
A binding date, or at least a determinable completion period, belongs in every property developer contract. If it is missing or vaguely worded ("expected"), you can hardly enforce claims for delay, while you pay rent and commitment interest at the same time.
Clauses under which an expert chosen by the developer or the initial property manager accepts the common property take away your control over the most important moment of the project: acceptance starts the limitation periods and reverses the burden of proof. According to case law, such clauses are often invalid, and we show you how to keep acceptance in your own hands.
