Suddenly, a shelf can be art! This ruling could turn the furniture industry upside down

When people buy a stylish designer shelf, they usually think of style, quality, and a hefty price tag. But hardly anyone asks themselves: Can a shelf actually be just as well protected as a painting?

This is precisely the intriguing question the Federal Court of Justice had to answer. At the heart of the matter is the well-known USM Haller furniture system, which has been used for decades in offices, law firms, and modern homes. The court has now issued a ruling that goes far beyond a single piece of furniture. It could determine in the future when creative products are protected from imitators—and when they are not.

What was this all about, anyway?

The Swiss manufacturer USM is convinced that its well-known shelving system is much more than just a practical piece of furniture. The company sees it as a unique creative achievement.

However, a competitor offered compatible components that allowed customers to assemble virtually identical pieces of furniture. In addition, complete pieces of furniture were assembled from these parts and sold. From USM's perspective, this constituted an unauthorized copy.

So the intriguing question was: Is this merely a functional shelf, or does it feature a creative design that deserves special protection?

The Federal Court of Justice overturns the lower court's ruling

Another court had previously ruled that, although the piece of furniture was well known, it did not meet the requirements for particularly broad protection.

The Federal Court of Justice, however, took a more critical view. In its opinion, the bar had been set too high. The decisive factor, it argued, was not whether an object appeared particularly spectacular or extraordinary. Far more important, it said, was the question of whether the designer had made genuine creative decisions that went beyond mere function.

That is why the case must now be reviewed again. That does not necessarily mean that USM will automatically win in the end. But its chances have increased significantly.

Why doesn't this apply only to furniture?

This ruling is of interest to many industries. After all, creative design can be found everywhere. Designers can invest a great deal of time and ideas into lamps, chairs, packaging, kitchens, lighting fixtures, and even everyday objects.

If courts become more willing in the future to recognize that such products involve creative work, manufacturers could more easily defend their designs against copycats.

On the other hand, it becomes more difficult for competitors to bring similar products to market. This is precisely where the balancing act lies: creativity should be protected, but at the same time, competition must not be unnecessarily restricted.

What does this mean for consumers?

For buyers, little will change at first. No one needs to worry that their own shelf will suddenly be banned.

In the long run, however, such decisions could have an impact on prices and product selection. If manufacturers can better protect their designs, the number of low-cost alternatives may decrease. At the same time, it will be more worthwhile for companies to invest in new ideas and innovative products.

So, in the end, it comes down to a fundamental question: How much protection does creativity need—and how much competition does the market need?

The decision isn't the end yet

The Federal Court of Justice has not issued a final ruling on the dispute. Instead, the competent Higher Regional Court must review the case again, taking into account the guidelines set by the highest courts in Germany and Europe.

It will be necessary to examine closely whether the USM Haller system is in fact the result of an independent creative design or whether its form is primarily determined by technical requirements. Only then will it be clear whether this famous piece of furniture will actually receive the extensive protection that the manufacturer is seeking.

When a shelf suddenly becomes more than just a shelf—and why that’s catching the attention of all designers right now

This case clearly demonstrates that the law is by no means limited to books, music, or movies. Even everyday objects can become the focus of major legal proceedings.

The courts have yet to definitively determine whether a shelf ultimately qualifies as a creative work deserving special protection. One thing is already certain, however: The decision will attract attention far beyond the furniture industry and could bring about lasting changes in how design is treated in Germany.

Creative works naturally deserve protection. Anyone who spends years developing ideas and creating a timeless design should not have to stand by and watch as others simply profit from them.

Nevertheless, protection must not go so far that, at some point, every screw, every shape, or every combination of metal and color becomes practically off-limits. Innovation often arises when companies build upon and improve upon what already exists. If every design classic becomes untouchable, competition ultimately suffers—and the consumer ends up footing the bill. Protect creativity—yes. But please, with a sense of proportion. After all, a beautiful shelf shouldn’t turn into a high-security legal prison.
